On 14 March 2011, member Cheung Kai-tak was convicted at Kwun Tong Magistrates’ Courts under MPF Ordinance s.43E(1) and fined HK$6,000 for false and misleading statements claiming permanent departure. The same day, two employers were convicted: Kwok Pui-man of Pui Ying Beauty Trading was fined HK$48,000 for failing to enrol staff and defaulting contributions; Chu Yan-tak of Tak Shing Auto Body Works was fined HK$41,000 for multiple defaults. The Small Claims Tribunal also ordered Ka Wai Food to pay a HK$5,000 default surcharge.
Prosecution and fines apply, plus the MPFA recovers arrears and surcharges; offenders are named on the MPFA’s public defaulting-employers register.
