Why Were Four Members Fined for False Statements to Claim MPF?

What Happened?

Four MPF scheme members — Wong Kin Wai, Lo Fat Hoi, Chan Kam Keung and Mok Chi Wan Alan — applied to trustees between November 2009 and April 2010 for early withdrawal on the ground of permanent departure. MPFA investigation found they had recklessly made false and misleading statements, claiming they had never before claimed accrued benefits on an earlier departure.

What Was the Sentence?

All four were convicted at Kwun Tong Magistracy of breaching section 43E(1) of the MPF Ordinance and fined $6,000 each — $24,000 in total.

Were There Other Prosecutions the Same Day?

Two officers and eight employers were also convicted of Ordinance offences and fined a total of $491,000. The MPFA reminds members that early withdrawal requires statutory grounds and truthful declarations — false statements will be prosecuted.
