Four employers fined HK$75,000 for MPF offences

What penalties do employers face for failing to enrol staff or defaulting on contributions?

Employers who fail to enrol employees in an MPF scheme or commit MPF default contributions face criminal prosecution and fines. On 6 September 2011, four employers were convicted at the Kwun Tong Magistrates’ Courts for breaching the Mandatory Provident Fund Schemes Ordinance and fined a total of HK$75,000. The heaviest penalty went to Manspower, run by Lo Tsz-keung, fined HK$52,000 for failing to make MPF contributions for one employee from November 2008 to December 2010.

The cases show long-running MPF default contributions draw far heavier fines than single-month arrears. Employers should enrol staff and contribute on time — see the employer MPF obligations guide.
