Why Was the Nail Salon Prosecuted?

Wong Yan-ting (formerly Wong Ho-wai), a 2000 Miss Hong Kong finalist and former TVB host, went into the nail-salon business — and her company was summonsed for failing to enrol staff in MPF and make contributions. The defendants admitted 16 summonses covering about $13,100 in contributions over eight periods from June 2009 to January 2010.

What Was the Sentence?

The magistrate accepted it was a moment of negligence and imposed fines totalling $37,500. The three defendants were the company, director Wong Ho-wai and general manager Yam Siu-wah; nine of the original 27 summonses were dropped.

What Was the Employer’s Excuse?

The defence said the company had hired an experienced beautician as a business partner and wrongly assumed profit-sharing meant no employment relationship — not a deliberate offence. The MPFA reminds employers they must enrol staff and contribute on time; breaches can be prosecuted.
