Some 2,400 employers were caught breaching the MPF Ordinance over five years; 13 are repeat offenders, with some firms prosecuted three times. The MPFA’s “Records of Non-compliant Employers and Officers” search platform launches next Monday — but the first blacklist has a big hole: no directors’ names.
| Item | Figure |
|---|---|
| Non-compliant employers | ~2,400 (five years) |
| Civil rulings | ~3,000 records |
| Criminal convictions | ~600 records |
| Repeat offenders | 13 (past year) |
| Heaviest fine | HK$258,000 (children’s book firm) |
| Complaints | Down 30% in 2010/11; average penalties up 85% |
Citing privacy and legal concerns, the MPFA won’t publish directors’/officers’ names for pre-24 May violations — only post-launch convictions. Labour lawmaker Ip Wai-ming slams it: workers can’t check rogue employers’ track records; publish everything equally.
Records show a firm prosecuted again after renaming itself (Wa Chi Union → Apple Green Limited); one manager’s two factories offended in turn, but the search page won’t show manager links — connections stay hidden.
The blacklist is progress, but hiding directors’ names leaves rogue employers a back door. Before changing jobs, check your prospective employer on the MPFA site. Compare MPF funds’ fees and returns at MPF fund comparison.
